The Court of Appeal held that s57A(a)(iii) should not be construed narrowly in the Hong Kong context and that, on the materials available, the applicant may possess an interest materially greater than that of ordinary members of the public due to his connections with ancillary Buddhist institutions and complaints from worshippers; accordingly the strike-out was set aside and the matter remitted for reconsideration with directions to allow the applicant to file further evidence.
