The trial judge was entitled to disbelieve the appellant's evidence on credibility grounds; the prosecution had established the elements of the offence beyond reasonable doubt and the appellant failed to prove the statutory defence that he would not have known the cargo was undeclared even after taking reasonable steps, therefore the conviction is safe and must be upheld.
