Defendant's conditional repayment defence and alleged waiver are not credible and raise no triable issue; although there is a triable issue on whether Plaintiff carried on a money lending business, on the evidential matrix before the court no reasonable court would refuse to exercise the discretionary provisos in ss 18 and 23 MLO; accordingly summary judgment is entered for the Plaintiff for HK$506,000 with interest at HK$6,000 per month from 17 July 2006 until judgment and thereafter at judgment rate.
