The court held that the TPB breached its duty of inquiry in failing to properly investigate and explain the basis for V zoning with respect to proven genuine Small House needs and failed to inquire into mapping inaccuracies affecting Hoi Ha CPA buffer; given those material defects and absence of reasons from the CEIC to show independent correction, both the TPB and CEIC decisions were quashed and the draft OZPs were remitted to the TPB for reconsideration of the identified issues.
