The court held that the Australian Court Rates (Cash Rate plus 4% as applied in Australian Federal Court practice) represent the commercial borrowing rate for a reasonable notional borrowing in Australia and are an appropriate proxy for the Hong Kong norm of prime rate plus 1%; accordingly the Australian Court Rates were adopted as the pre-judgment interest rates for the judgment sum and no additional 1% was added on top of those rates.
