Because the court was bound by the Privy Council decision in A-G v Cheng Yick Chi and later Court of Appeal authorities, the appeal had to be dismissed: for the purposes of the Buildings Ordinance a 'site' is limited to land which a person owns or has a realistic prospect of controlling, and the Building Authority may require particulars or proof of ownership or realistic prospect of control when considering approval under s.14(1).
