    The High Court on a s.9J review is governed by Part IA of the Criminal Procedure Ordinance (Cap.221) and s.10(5) of the Fugitive Offenders Ordinance (Cap.503) does not apply to the High Court; applying the s.9G test the court may refuse bail where substantial grounds exist to believe the accused will fail to surrender; given the seriousness of the alleged offences, the US affidavit describing the applicant as a major flight risk and the prospect of severe foreign sentences, the judge concluded the applicant was a flight risk and refused bail, confirming the magistrate's decision.
