Extension of time refused because the applicant failed to provide any reasonable explanation for the delay and no realistic prospect of success on the merits: he failed to supply evidence required by s37ZG to re‑open the withdrawn torture/non‑refoulement claim and the Judge committed no reviewable error.

Application for leave was dismissed and extension of time refused because the applicant delayed approximately eleven months without satisfactory explanation, had no realistic prospect of success on the merits as the Board correctly applied section 37ZG and found the applicant's reasons (family care and lack of transport funds) were not circumstances beyond his control, there was no procedural unfairness and the Board's conclusions were not Wednesbury unreasonable.

The court refused to extend time and dismissed the leave application because the applicant was more than two years four months late without adequate explanation, the intended challenge lacked any prospect of success as the Director and Board reasonably found that the applicant’s fear and conduct did not amount to circumstances beyond his control under s37ZG, and there was no error of law or procedural unfairness in the decisions below.
