The Court held that the hypothetical landlord must be assumed to repair readily remediable defects that are economically reasonable to remedy; a private landlord's intention to redevelop is immaterial and cannot justify an additional deduction for redevelopment; applying these principles the Tribunal's excessive deduction for redevelopment was reduced and the correct rateable value was fixed at HKD 16,800.
