On the facts the Applicant was an employee of the Respondent because Respondent supplied the lorry and pallet truck, paid or reimbursed expenses, set work routines and payment arrangements and retained the benefits and obligations of the contract; alternatively, even if Lam were the immediate employer, the Respondent was liable as principal contractor under s24 ECO; failure to strictly comply with s24(6) did not bar the claim where the principal contractor knew the subcontractor and particulars and suffered no prejudice, consistent with a purposive interpretation of the ECO.
