The District Court lacked jurisdiction to order possession because the tenancy continued under Part II of Cap.7 and such matters must be brought in the Lands Tribunal; the landlord had not established entitlement to recover the increased rent because he failed to serve a valid section 61 notice and the Commissioner was not empowered to back-date the effective date of the increase so as to circumvent the notice requirement, therefore the claims for arrears and possession were dismissed on review.
