The appeal court held that the magistrate's custodial sentence should be suspended because the appellant was a first offender with substantial mitigating factors (guilty plea, cooperation, low value and profit, family and employment circumstances) and that imposing a deterrent sentence in rem on a first offender was inappropriate; accordingly the four weeks imprisonment was suspended for 12 months.
