The Court held the judge's interventions, though perhaps excessive, caused no substantial prejudice and the summing-up adequately directed the jury to consider the 1st appellant's evidence and exhibits; the jury were entitled to find the s.47 presumption was not rebutted by the 2nd appellant on the balance of probabilities, therefore the convictions stand and the appeal is refused.
