Where a seized mixture contained salts of esters of morphine but did not contain the drugs specified in s.46(c)(vi) and (e) in the prescribed minimum quantities, the statutory presumption of possession for the purpose of trafficking under s.46 did not arise; therefore convictions for trafficking were unsustainable, the correct conviction was simple possession, and the court properly substituted convictions and reduced sentences accordingly.
