The trial judge correctly accepted the complainant's clear, consistent and credible testimony and, insofar as the forensic report was neutral but consistent with possible penile penetration, the prosecution proved both offences beyond reasonable doubt; the appellate court will not disturb a credibility finding by the trial judge absent demonstrable misdirection or error.
