The defendant failed to establish a bona fide defence: the receipt evidenced payment of rent (negating adverse possession) and, in any event, the statutory renewal of the Crown lease on 1 July 1973 created a new lease from which the 20‑year limitation period runs; the plaintiff's writ issued within that period, so the claim is not statute‑barred and summary judgment for the plaintiff was warranted.
