The court held that the intervener's applications for a stay and for leave to appeal were without merit because the intervener had already had the opportunity to present evidence and submissions (filed for the stay) and there was no additional material to be advanced; however the court accepted it had mistakenly proceeded on the assumption that the 2nd defendant was neutral as to the orders on the Originating Summonses in HCMP 801 and 802, and accordingly granted the 2nd defendant leave to appeal and stayed the orders against it, with costs of the application to be costs in the appeal.
