It is permissible for a plaintiff to commence Order 14 summary judgment proceedings after a defendant has applied for a stay under the Arbitration Ordinance, but the stay application must be heard first; the Order 14 may be listed to be taken immediately after a refused stay, particularly where the stay is refused because there is no arbitrable dispute due to an unequivocal admission, otherwise the court may defer or relist the Order 14; if the stay is granted the Order 14 is dismissed and costs normally follow the event.
