The Court declared the detention of the applicants unlawful following their convention/torture claims but refused to grant an interim stay of the effect of its judgment; while a court may stay a declaration, such a stay does not render the judgment void as an authoritative statement of law and the Director must implement revised policies and procedures to comply with Article 5 HKBOR and make them accessible to detainees.
