Given the strong prima facie case of beneficial entitlement in favour of the patient, the absence of opposition by the companies and the absence of probate (so no demonstrable prejudice to the estate), the court will grant stop orders under Order 50 r.15(1) restraining transfers and payments pending the substantive action and will not require an undertaking as to damages to the deceased's estate, while requiring an undertaking as to damages in favour of the companies.
