The court found that the area in front of 42-44 Nam On Street is a street in both ordinary and statutory senses and, on the evidence, exceeds 4.5 metres in width. The Crown failed to produce evidence of any lawful stopping up (no writ ad quod damnum, no Gazette notices under relevant statutes). Therefore Regulation 19 applies as the site abuts a street exceeding 4.5 metres and the declaratory relief in paragraph (bb) is granted.
