Leave to appeal was refused because the application had no reasonable prospect of success and no other reason in the interests of justice: the Building Authority would not approve demolition that failed to ensure structural safety, the amendments by R4 addressed the intervener's concerns which can be determined at trial, and the interveners delay in issuing the summons undermined their case.
