The possession order obtained against the principal tenant was ineffective because the principal tenant had surrendered possession before the application, and upon surrender lawful sub-tenants became direct tenants of the applicant (Part IV) so the applicant's remedy lay under Part IV; the applicant failed to follow Part IV procedure (did not serve CR101) and therefore the application against the co-respondent must be dismissed and the earlier possession order against the respondent is a nullity.
