Applications for possession were dismissed because the landlord failed to satisfy the Tribunal of the mandatory condition requiring fixation of when rebuilding works should commence and be completed (ss.53A(2)(b)/119F(2)(b)), largely because the 1984 informal transfer resulted in a surrender by operation of law creating a Part IV tenancy and s.119P(8) made sub-tenants direct tenants whose protection prevented the Tribunal from lawfully fixing redevelopment dates now; estoppel was not proven and landlord’s timing certainty was therefore inadequate.
