The Court found that the 1st Defendant had shared the use and occupation of part of the demised premises in breach of clause 2(g); the Plaintiff's assignment expressly included the benefit and right to sue for that covenant; although relief from forfeiture is discretionary, the Defendant's deliberate dishonesty, concealment, fabrication of letters and conspiracy made it unconscionable to grant relief, so forfeiture was upheld and possession awarded to the Plaintiff.
