On a broad macroscopic assessment the prior judicial findings together with contemporaneous ledger and voucher documents established a clear prima facie case that KING WONG DEVELOPMENT LIMITED incurred the debt claimed; therefore the provisional liquidator's wholesale rejection of the Preliminary Proof was invalid, KWD Ltd was entitled to vote at the meeting in respect of the Debt, and the resolution appointing the provisional liquidator must be set aside, with a new liquidator appointed and costs awarded to the plaintiffs.
