Defendant was in repudiatory breach and, given the prolonged lapse, lack of completion, dissolution of the company and absence of any real prospect of specific performance, the provisional agreement ceased to affect land and the court properly exercised its inherent jurisdiction to vacate its registration and declare it no longer registrable.
