Where a witness professes to be a Christian or Jew, he must either take the statutory oath or make the statutory affirmation; refusal to do so authorises the magistrate to impose punishment under section 21(4) of the Magistrates Ordinance; the fine of $250 with 14 days to pay (default 14 days' imprisonment) was not excessive and the magistrate's decision was correct.
