The Interveners established triable issues on both (1) that the 2007 purchase money may have come from the Father (supporting a resulting trust) and (2) that Mr Ho may have been in actual occupation in 2011; those triable issues defeat a summary disposal under Order 88, so summary judgment was refused and the joinder application allowed.
