The proposed appeal had no reasonable prospect of success because there was no evidence the ancestral hall could have authorised a tenancy (no manager 2003–2018 and no proof of authority by the alleged lessor), the judge's summary judgment and dismissal of the counterclaim were properly founded, and the judge had no duty to prompt the fourth defendant to apply to adduce new evidence; accordingly leave to appeal was refused and costs were awarded to the plaintiffs.
