Where a prosecution withdraws a charge the court will presumptively award costs unless the defendant’s conduct, insofar as it is relevant to the charge, has brought suspicion upon him; on the facts the appellant’s acceptance of a private ride for HK$200 without knowing the destination and permitting unknown passengers to board, together with unusual driving, legitimately attracted suspicion related to the trafficking allegation and justified the Magistrate’s refusal to order costs.
