The conviction was upheld because the admitted facts, CCTV and photographs proved the appellant intentionally inserted a tissue into the complainant's exhaust, and the visual evidence showed the tissue occupied at least half the exhaust outlet so as to alter its exhaust function; expert evidence was unnecessary and the conviction and sentence were safe.

Conviction was safe: cumulative circumstantial and forensic evidence (matching fragments, shoe imprint and stripe imprints, eyewitness timing) permitted inference that defendant was the driver who struck and ran over the deceased. The original overall sentence of 2 years 8 months was manifestly inadequate given aggravating features; appropriate overall sentence is increased to 3 years 3 months imprisonment and driving disqualification for four years.

Although the trial judge erred in structuring the sentences (concurrency), the total sentence of twelve months imprisonment was not excessive in all the circumstances; leave to appeal granted but the appeal is dismissed and the sentences are upheld.
