The Court held the essential features of the applied‑for shapes are functionally necessary to obtain technical results (storage/protection/stability for consoles, ergonomic two‑handed control for controllers, fitting/connection and insertion for the memory card) and, being common functional shapes, lack inherent or acquired distinctiveness; accordingly registration is barred by TMO s.12(3)(b) and the appeals are dismissed.
