The court found that the defendants, by failing to fix the renewal premium and by expressly agreeing to 'hold covered' pending formal renewal/decision, kept the insurance effective and were on risk on 27 November 1981; the insurer's contention of repudiation by market solicitation failed; accordingly plaintiff entitled to recover the HK$250,000 minimum benefit subject to deduction of the appropriate premium.
