The Commissioner failed to justify a six-month temporary suspension because he had ample time and resources over years to formulate compliant options; the three proposed options were not complex and did not justify continued suspension. Consequently the declaration that SO 41-05 is directly discriminatory must take immediate effect, certiorari must issue to quash the decision of 9 June 2014, and ancillary procedural and costs orders follow, including refusal of a certificate for three counsel and grant of certificate for two counsel.
