On the facts the Defendant repeatedly matched payments corresponding to the Plaintiff's landlord obligations, the Plaintiff had no other income and therefore the irresistible inference was that the Defendant agreed by conduct to vary the Rent, Fees and Rates; consequently there was no bona fide dispute and the Plaintiff's claim for the Outstanding Rent, Fees and Rates should succeed, making it unlikely the Defendant's counterclaim should proceed to trial.
