The Court held that the contemporaneous documentary evidence established a mutual postponement of the tenancy commencement to 6 March 1999 while preserving On Parks right to claim losses arising from Governments failure to give vacant possession on 1–5 March 1999; the only proved loss was the wasted pre-paid rent of HKD 183,940.30 for those five days, Government was entitled to an indemnity from West Coast for that liability, West Coast was bound by the trial result and had no successful ground of appeal, and the appeal was therefore dismissed.
