Where proceedings are governed by Part II of Cap.7 the court has no jurisdiction to make an order for possession by consent (including by means of a Tomlin Order that has the same effect) unless a statutory ground under s.53(2) is established or plainly admitted; parties cannot confer jurisdiction by agreement and the court must be satisfied it has jurisdiction before making or enforcing such an order.
