On the balance of the evidence including detailed psychiatric reports by Dr Wong and Dr Hung, corroborating documentary evidence from care providers, and direct oral responses from LKS in court, the judge was satisfied that LKS is not a 'mentally incapacitated person' under the Mental Health Ordinance; the applicant's request to terminate proceedings was refused and there was no basis to appoint a trustee; prior interim undertakings were discharged.
