Regulation 4 of the Import and Export (General) Regulations construed with section 94A of the Criminal Procedure Ordinance places upon an exporter the burden of proving that the exportation was under and in accordance with the licence; the regulation is within the enabling power and does not contravene the Bill of Rights because the burden is reasonable and dischargeable by a bona fide exporter; accordingly appeal dismissed and convictions upheld.
