The court held that s.26(4) of the Theft Ordinance expressly treats property obtained by blackmail as stolen; accordingly the theft charges were sustainable despite the appellant's asserted belief in a claim of right, and the evidence supported conviction for blackmail. The convictions and an aggregate sentence of 8 months were therefore affirmed.
