Because the CCTV and case history established deliberate provocation by the victim and a pre-existing hostile relationship, those mitigating features materially distinguished this theft from ordinary mobile phone theft and justified reducing the immediate custodial term to a one‑month imprisonment suspended for 12 months.

Given the opportunistic theft of a smartphone worth HK$12,000 from an unconscious person, the sentencing starting point of 12 months was appropriate; applying a one‑third reduction for an unequivocal guilty plea produced a justified 8‑month sentence which is not excessive, and the court correctly ordered that the 8‑month term run consecutively to the separate sentence being served because the offences were independent.

The appellate court accepted that the offences involved planning and manipulation and that extortion in charge 1 aggravated the offence; applying relevant authorities and the totality principle the sentences were re-calibrated to 9 months for charge 1 and 6 months for charge 3 (with 3 months concurrent and 3 months consecutive) producing an overall sentence of 12 months imprisonment.
