Defendant failed to prove, to the requisite civil standard, that the Plaintiff acted as agent for or in collusion with the fraudulent third parties; available documentary and witness evidence (referral from Imperial Accounting, Approval Memorandum and attending staff accounts) showed the Plaintiff legitimately approved the loan and had no knowledge of or participation in the fraud; therefore the Agreement was lawful and enforceable and the Plaintiff was entitled to judgment for the loan and delivery up of the property.
