Third‑party funding of solicitors does not prevent a successful litigant from recovering costs from the losing party unless there is a binding agreement that the litigant will not be liable to the solicitors; the solicitor's letter did not amount to such an agreement, the respondent failed to take reasonable steps to effect personal service in breach of the Bankruptcy Rules, and therefore the applicant was entitled to costs on an indemnity basis.
