Applying NSL s42(2) and the guidance in HKSAR v Lai Chee Ying, the court concluded there were insufficient grounds to believe the respondent would not continue to commit acts endangering national security if released; therefore the stringent NSL bail threshold was not met and the Secretary for Justice's application to revoke the Chief Magistrate's bail order was refused, although the court found the existing bail conditions would ensure surrender under the CPO test.
