Leave to appeal against conviction was dismissed because the appellate judge accepted the trial judge's meticulous assessment that the CCTV footage, despite time differences, captured the transactions and that identification was established by comparison with the applicant's video interview, distinctive clothing and tattoo and proximity of residence; the proposed fresh photographic evidence was refused as unsuitable at appeal stage.
