Although the Single Judge had found the grounds reasonably arguable for leave, the higher qualitative threshold for bail pending appeal — a strong likelihood or prospect of success — was not met on the material before the Judge; Ma Kin Yiu was factually distinguishable; and the time factor was not present, therefore bail pending appeal is refused.
