The court held that the costs order pronounced orally on 3 July 2014 was an order nisi irrespective of the sealed form; the defendant could have applied for variation or for costs under Order 22 r23 within the 14 day period but failed to do so; leave to amend the sealed order to record it as an order nisi was granted, but because of the defendant's unnecessary delay and correspondence the costs consequences were apportioned against the defendant for conduct after 18 July 2014.
