Leave to appeal was refused because (1) fresh leave applications and fresh originating summonses were lawful and cured any procedural effect of the lapse in the earlier leave; (2) there is no sound basis to import the six-month time-bar in Magistrates Ordinance s26 to committal for criminal contempt which addresses serious interferences with the administration of justice; (3) the alleged non-disclosure of the lapse was not material in the circumstances; and (4) no legitimate expectation arose that magistrates' protections barred committal proceedings.
