The leave application was dismissed because the Director's Decision had been superseded by the Board's Decision of 25 August 2020 and therefore was not susceptible to judicial review; the application was also out of time and would have been dismissed on that ground in any event.

The summons for security for costs was dismissed because the defendants made the application unreasonably late (more than seven months after the appeal was set down and with significant costs already incurred), they knew of the plaintiff's impecuniosity earlier and gave no explanation for delay; lateness outweighed the defendants' risk of non‑recovery, so security was refused and no costs order made for the summons.

The application for a charging order was validly brought on the date the supporting affidavit was filed (13 December 2016) and thus within the 12‑year limitation period; the Limitation Ordinance bars bringing enforcement proceedings after 12 years but does not prevent the court from making orders after expiry where proceedings were commenced in time; interest is limited to the most recent six years and earlier arrears are time‑barred.

The application for consolidation was refused because it was not made as soon as practicable; the three arbitrations were at materially different stages (with the 1st and 2nd nearly ready for substantive hearing and the 3rd at an initial stage), the plaintiff's delay was largely self-induced, and consolidation at that late stage would cause 12–18 months delay and disproportionate expense to the 1st and 2nd Defendants.

Although the court has a residual discretion to order a jury trial despite an out‑of‑time application under s.33A(2), the defendants failed to provide sufficient explanation or affidavits justifying variation of the earlier order; the issues (privilege) are mainly legal and not appropriate for a jury; therefore the discretion was not exercised in the defendants' favor and the application was dismissed with costs to the plaintiff of $3,500 payable forthwith.
